NOTICE & CONSENT UNDER PERSONAL DATA PROTECTION ACT 2010

ACGT Sdn Bhd, its subsidiaries and related corporations (“ACGT”, “our”, “us” or “we”) respect the privacy of individuals with regard to personal data. This Personal Data Notice is formulated in accordance with the Personal Data Protection Act 2010 and regulations, standards, policies and code of practice made thereunder (“Act”) and it explains how we collect and handle your personal information in accordance with the Act. For the purpose of this Personal Data Notice, the terms “personal data”, “sensitive personal data” and “processing” shall have the same meaning as prescribed in the Act.

1. Collection of Personal Data

We may request that you provide personal data in the course of your dealings with us. This is to enable us to enter into commercial transactions with you, or deliver the necessary services or information in connection with our services or products. By signing at the end of this Personal Data Notice, you are giving your consent to us to process of your personal data and sensitive personal data (collectively known as “Personal Data” for the purpose of this notice).

2. Description of Personal Data

In this regard, we may process your Personal Data such as:

  1. Name, photograph, images and footages;
  2. race, ethnic origin, nationality;
  3. contact information including address, email address and phone number;
  4. such other relevant information and data to enable us to provide you with our services or information in connection with our services or products.

3. Purpose of collection of Personal Data

Your personal data is or will be collected and processed by us for the following purposes:

  1. preparation and execution of all necessary documents and agreements for our services and/or products including any obligations arising from any agreements entered into between you and us and to provide you with the information and services that you request from us;
  2. implementation, performance and completion of any commercial transactions, dealings or in connection with the services and/or products that we may provide to you;
  3. reporting to relevant regulatory authorities and meeting any legal or regulatory requirement relating to our services and/or products and to make disclosure under the requirements of any applicable law, regulation, directive, guideline, by-law, code, circular, government authorities and/or court of competent jurisdiction;
  4. maintenance and upkeep of internal client records, administration, management, business development, advertising, research, internal operations, troubleshooting, data analysis, statistical and survey purposes and social activities;
  5. to enable us to communicate advertising or marketing materials with you or send you information by email, regular postal mail, telecommunication means (including but not limited to telephone calls, text messages, social chat applications) about our services and/or products;
  6. dealing with administration, billing, complaints and any other purposes relating to services and/or products provided to you;
  7. to operate our website and information technology software (including the collection of internet protocol address and cookies) including all internet related activities;
  8. to allow you access any application, web portal or online platforms, owned, operated or managed by us or on our behalf;
  9. to enable us to send you information by email, regular postal mail, telecommunication means (including but not limited to telephone calls, text messages, social chat applications) about services offered by selected third parties that we think may interest you but in doing so we maintain control over your Personal Data and we will not disclose your Personal Data to such third parties without your prior consent;
  10. to publish photographs, images or video footages of you, which are captured during our participation in any or our events, on our website or other social media or at our premise;
  11. to grant you access to any premises/facilities, including the premises/facilities owned, operated or managed by us or on our behalf;
  12. to protect your safety and wellbeing and that of other visitors to our premises; and
  13. for such other purposes related or ancillary to the foregoing purposes.

The abovementioned purposes shall hereinafter collectively be referred to as “Purposes”.

4. Source of Personal Data

The Personal Data which may be collected, processed and used by us are sourced from sources such as:

  1. our official forms (printed or electric) submitted or completed by you or on your behalf, including booking/application forms, visitor/guest lists, inquiry forms or other relevant forms or documents;
  2. any queries, emails, correspondences or documents that we receive in the course of any communications between you and us;
  3. CCTV recordings or footages when you visit our premises in person,
  4. your business cards that were dropped or given to us or our employees;
  5. and all other information that you may provide us from time to time.

5. Disclosure of Personal Data

You hereby consent and authorise us to provide or disclose your Personal Data to the following parties:

  1. Our related companies,

  2. our third party service providers, our business partners to implement the Purposes and to provide related services in connection with our services and/or products;

  3. our auditors, consultants and professional advisors;

  4. such third party as requested for or authorised by you;

  5. any governmental departments or agencies, regulatory and statutory authorities; and

  6. any other third parties to implement any of the Purpose.

6. Safety and Retention of Personal Data

  1. We endeavour to implement the appropriate administrative and security safeguards and procedures in accordance with the Act, particularly the General Code of Practice of Personal Data Protection, to ensure that any Personal Data held by us is protected against any loss, misuse, modification, unauthorised or accidental access or disclosure, alteration or destruction.
  2. Any Personal Data supplied by you will be retained by us as long as they are necessary for the fulfillment of the Purposes, required to satisfy any legal, regulatory or accounting requirements or to protect our interests. Your Personal Data will be permanently deleted once they are no longer needed or required for the abovementioned purposes.

7. Consequences of Refusal or Failure to Provide Personal Data

You have the right to refuse to provide your Personal Data. However, when it is obligatory to provide us your Personal Data, your refusal or failure to do so may result in the following consequences in which we shall not be held liable:

  1. inability to provide you with any of our services or products;
  2. inability to finalise any agreement or complete any commercial transaction;
  3. inability to keep you apprised of any information requested or information regarding our services or products.

8. Right to Access, Correct, Limit and Withdraw the Processing of Personal Data

You have the right to access, correct or update your Personal Data, limit the processing of your Personal Data, withdraw the consent to process your Personal Data, and to make any inquiries or complaints in respect of your Personal Data by contacting us at:
